Updated Divorce Law in England & Wales set to finally end the “blame game”

New legislation will soon enable separated couples to divorce amicably without the need to blame their spouse for the breakdown of their marriage. There is only one ground for a divorce in this country, which is the irretrievable breakdown of the marriage. As the law stands, in order to prove this, one of five facts must be established. The petitioner (person starting the divorce) needs to prove that there has been fault on the part of the spouse or wait for 2 years to start the divorce. Changes to divorce laws – what does it mean?

The government this week has announced proposed changes to divorce laws which will allow couples to divorce without blaming the other party, in a move which will hopefully allow for more amicable separations. This will change laws that have been in existence for 50 years and is a change that family law professionals and experts have been campaigning for years to be introduced.
